Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Iskra platform, websites, applications, and related services (collectively, the "Service") operated by Almadar Alearabia For Marketing ("Iskra," "we," "us," or "our"), a company registered in the United Arab Emirates.

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Iskra provides AI-powered "employees" that perform business automation tasks including lead capture, conversation handling, appointment booking, content generation, and related workflows. The specific capabilities available to you depend on the subscription plan you select.

2. Eligibility & Account

You must be at least 18 years old and authorized to enter into contracts on behalf of any organization you represent. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at info@iskra.marketing if you suspect unauthorized access.

3. Subscriptions, Setup Fees & Billing

The Service is offered on a paid subscription basis. Plans include a one-time setup fee plus a recurring monthly subscription fee, billed in U.S. Dollars (USD).

• Recurring billing: Subscriptions auto-renew each month on the anniversary of your first payment until you cancel.
• Payment processor: Payments are processed by Stripe, Inc. By subscribing, you authorize Stripe and Iskra to charge your selected payment method on a recurring basis.
• Failed payments: If a payment fails, we may retry, suspend Service, and ultimately terminate the account if unpaid.
• Price changes: We may change prices on 30 days notice; changes apply to subsequent billing cycles.
• Taxes: Prices exclude VAT, sales tax, or withholding tax, which you are responsible for.

4. Refund Policy

Because the Service involves immediate provisioning of AI infrastructure:

• Setup fees are non-refundable once your AI Employee has been provisioned (typically within 24 hours). Before provisioning, setup fees are refundable on request.
• Monthly subscription fees are refundable within 14 days of the first monthly charge if you have not yet used the Service materially. After 14 days, monthly fees are non-refundable but you may cancel anytime to avoid future charges.
• Cancellations take effect at the end of the current billing period.
• Refund requests: info@iskra.marketing. We respond within 3 business days.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, phishing, or unsolicited bulk messages, or violate anti-spam laws (CAN-SPAM, GDPR, UAE TDRA).
• Engage in fraud, money laundering, or illegal activity.
• Harass, threaten, defame, or harm any person.
• Distribute malware or compromise the Service.
• Reverse-engineer, copy, or resell the Service without written permission.
• Operate in industries prohibited by Stripe (firearms, adult content, unlicensed gambling, MLM schemes, unregulated pharmaceuticals).

5a. User-Generated Content — Zero Tolerance

ISKRA has zero tolerance for objectionable content and for abusive users. This applies to everything a person can put in front of another person on ISKRA: posts, videos, captions, product listings, comments, questions, messages, store names and profile pictures.

The following is objectionable content and is not permitted anywhere on the Service:

• Sexual content, nudity, or any sexualisation of a minor.
• Slurs or attacks on a person or group by race, ethnicity, nationality, religion, gender, sexual orientation, disability or age.
• Threats, harassment, bullying, stalking, or encouraging self-harm.
• Violent, graphic or cruel imagery, and content promoting terrorism or organised violence.
• Content that defrauds, impersonates, or exists to move a buyer off the platform in order to cheat them.
• Anything unlawful in the country the account operates from.

By creating an account, or by signing in, you agree to these terms and you agree not to post objectionable content and not to behave abusively toward other users.

How this is enforced. Content is screened before it is published, both on the device and again on our servers. Any user can report content from the item itself, and any user can block another user — blocking removes that person's content from the blocker's view immediately and notifies us. We review every report within 24 hours. Content found to be objectionable is removed, and the account that posted it is suspended or permanently terminated without refund. Reports concerning the safety of a minor are escalated immediately and reported to the relevant authorities.

6. AI Service Disclaimers

The Service relies on large language models and automated systems. You acknowledge:

• AI outputs may contain errors. You are responsible for reviewing output before relying on it for material decisions.
• We make no guarantee of specific revenue, lead volume, conversion rate, or business outcome.
• The Service is not a substitute for licensed professional advice (legal, medical, financial, tax).
• AI Employees may experience outages or content filtering from upstream providers.

7. Your Content & Data

You retain ownership of all business information, customer data, prompts, and content you submit ("Customer Data"). You grant Iskra a limited license to use Customer Data solely to operate, maintain, and improve the Service for you. We do not sell Customer Data and we do not use it to train third-party AI models. 8. Intellectual Property

The Service, including all software, designs, and brand marks, is owned by Iskra. We grant you a non-exclusive, non-transferable license to use the Service while your subscription is active.

9. Termination

You may cancel anytime from your dashboard or by email. We may suspend or terminate accounts for breach, non-payment, or risk to Iskra or other users. After termination, we may delete data after 30 days unless legally required to retain. Data export is available on request before termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISKRA AND ITS REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify Iskra against any claim arising from your use of the Service, your Customer Data, your breach of these Terms, or your violation of any law or third-party right.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Disputes that cannot be resolved by negotiation will be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be emailed to active subscribers at least 14 days before taking effect.
